BAIL GRANTED — Shrawan Das @ Faguwa Das (High Court of Jharkhand at Ranchi, B. A. No. 5040 of 2025, Ambuj Nath, J., decided 19.09.2025): accused in S.T. No. 46 of 2024 arising out of Karra P.S. Case No. 63 of 2023 for offences under Sections 353, 307, 34 IPC, Sections 25(1-B)a, 25(6), 26, 35 Arms Act and Section 17 C.L.A. Act, pending before District & Additional Sessions Judge-III, Khunti. Following a 14.08.2023 Karra police raid at Karamkuku forest on information that the petitioner, described as area commander of PFLI, was present with his group, during which miscreants fired at the police party without causing injury and co-accused were arrested with firearms recovered, the petitioner's name transpired in the confession of apprehended co-accused; he was not apprehended at the spot. Noting that co-accused Sitaram Das had already been granted bail by a Co-ordinate Bench vide B.A. No. 12013/2023, the Court enlarged the petitioner on bail on bonds of Rs. 20,000/- with two sureties of the like amount each, to the satisfaction of District & Additional Sessions Judge-III, Khunti.

Petitioner has been made accused in connection with S.T. No. 46 of 2024 arising out of Karra P.S. Case No. 63 of 2023 for the offences registered under Sections 353, 307, 34 of the Indian Penal Code and Sections 25(1-B)a, 25(6), 26, 35 of the Arms Act and Section 17 of the C.L.A. Act, pending in the Court of learned District & Additional Sessions Judge-III, Khunti.

On 14.08.2023, Karra police on the basis of confidential information that area commander of PFLI, namely Shrawan Das was spotted with his group at Karamkuku forest raided the place of occurrence.

On seeing the police party, the miscreants started firing at them. However, no police personnel sustained any injury. It is alleged that co-accused persons were arrested at the spot and fire arms were recovered from their possession.

It was submitted that the petitioner was not apprehended at the spot. It was further submitted that the name of the petitioner has transpired in the confession of apprehended co-accused persons. It was finally submitted that apprehended co-accused Sitaram Das, from whose possession firearm was recovered, has been granted bail by Co-ordinate Bench of this Court vide B.A. No.12013/2023.

In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned District & Additional Sessions Judge-III, Khunti, in connection with S.T. No. 46 of 2024 arising out of Karra P.S. Case No. 63 of 2023.
