The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 126(2)/117(2)/109/103(1) of the Bharatiya Nyaya Sanhita (B.N.S.), 2023.

Learned counsel for the petitioner submits that he has falsely been implicated in this case and for no offence he is languishing in judicial custody since 30.01.2025. The petitioner has got no criminal antecedent and nothing has been recovered from his possession. As such he may be enlarged on bail.

Learned A.P.P. opposed the prayer for bail.

Having regard to the facts of the case and looking to the allegation made against this petitioner, I am inclined to enlarge the petitioner on bail.
