2. The petitioner is apprehending his arrest in connection with Sisai P.S. Case No.51 of 2025 for the alleged offences registered under Sections 64, 351(2) and 351(3) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Sub-Divisional Judicial Magistrate, Gumla.

Learned counsel appearing for the petitioner submits that the motorcycle of the petitioner was forcefully kept by the husband of the informant and the same was not being returned to the petitioner, hence, the altercation took place and the petitioner has stated that he will lodge the case against the informant’s husband and in view of that false allegation of rape is made against the petitioner. He further submits that now the compromise has also taken place between the petitioner and the informant and that has

also come in the case diary. On these grounds, he submits that the anticipatory bail of the petitioner may kindly be granted.

4. Learned counsel appearing for the State submits that the compromise has taken place between the parties and that has been stated in paragraph No.8 of the counter affidavit. He submits that, however, Section 376 of IPC is not compoundable.

5. In view of the above and considering that the compromise has taken place between the parties, this petition is dismissed with liberty to the petitioner to surrender before the learned Court and pray for regular bail and the learned Court will pass appropriate order in accordance with law.
