The petitioner is apprehending his arrest in connection with Dhanbad P.S. Case No. 49 of 2025 registered under sections 109/115 (2)/126(2)/351/352/ 61(2) of BNS, 2023, pending in the Court of learned Chief Judicial Magistrate, Dhanbad.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He submits that the informant himself has been convicted under sections 376 (2) (1) of the I.P.C in which he has been granted bail by the High Court. He submits that after release, the present false case has been lodged against the petitioner by the informant and pursuant to that present anticipatory bail application has been filed. He submits that two of the co-accused has already been granted anticipatory bail by a Co-ordinate Bench of this Court in A.B.A. No.2271/2025 vide order dated 09.04.2025. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that in the confessional statement of the co-accused the name of the petitioner has come.

Considering that two of the co-accused persons have already been granted anticipatory bail by the Co-ordinate Bench of this Court in A.B.A. No.2271/2025 vide order dated 09.04.2025 and further it has been submitted that after release on bail the informant has lodged a false case against the petitioner, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner above named, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Dhanbad, in connection with Dhanbad P.S. Case No. 49 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
