Heard learned counsel for the parties.

Apprehending his arrest in connection with Seraikella P.S. Case No. 04 of 2021 corresponding to G.R. Case No. 411 of 2023 instituted under Sections 498A, 323, 34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act, the petitioner has moved this Court for grant of privilege of anticipatory bail.

Learned counsel for the petitioner submits that earlier anticipatory bail application of the petitioner was dismissed vide order dated 05.01.2023 passed in A.B.A. No. 4766 of 2022 with direction to surrender before the concerned court and pray for regular bail.

It is submitted that the petitioner has cooperated during investigation but neither surrender nor the above dismissal order was challenged before the Supreme Court. Now charge-sheet has been submitted on 25.08.2023. Hence, the petitioner may be admitted to anticipatory bail.

Learned A.P.P. opposed and submitted that the petitioner has simply filed an application reply before the I.A. and on that basis chargesheet has been submitted. There is no fresh ground for entertaining this anticipatory bail application of the petitioner.

Considering the above facts and circumstances and in view of earlier order passed by this Court and also in view of the fact that the charge-sheet has been submitted. No order on merits is required to be

passed.

Accordingly, this petition is disposed of with direction to the petitioner to seek remedy before the concerned court of Judicial Magistrate and file proper application which shall be disposed of in the light of guidelines laid down by the Hon’ble Apex Court in “Satender Kumar Antil Vs. Central Bureau of Investigation & Anr.” reported in 2022 (10) SCC 51 as well as the observation made in the case of “Satender Kumar Antil Vs. Central Bureau of Investigation & Anr.” reported in 2024 (9) SCC 198 .
