BAIL GRANTED — Ganesh Singh (aged about 73), accused in S.T. Case No. 207/2023 arising out of Palkot P.S. Case No. 10/2023 (G.R. No. 346/2023) for the offence registered under Sections 302 of the I.P.C., pending before the learned Sessions Judge-I-cum-Special Judge, Gumla, sought bail; his earlier bail application (B.A. No. 7540/2024) had been rejected by this Court on 28.11.2024. The allegation is that on 09.03.2023 he gave a lathi blow on the head of his wife, who succumbed to her injuries. Counsel for the petitioner submitted that even if the allegation were true, the case would prima facie fall under Section 304 of the I.P.C., as a single lathi blow showed no intention to kill, and that the petitioner was in custody since 27.03.2023. In view of these submissions, Ambuj Nath, J., directed the petitioner's release on bail on furnishing a bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of the learned Sessions Judge-I-cum-Special Judge, Gumla. Heard the parties.

The petitioner has been made accused in connection with S. T. Case No. 207/2023 arising out of Palkot P.S. Case No. 10/2023 corresponding to G.R. No. 346/2023, for the offence registered under Sections 302 of the I.P.C., pending in the Court of learned Sessions Judge-I-cum-Special Judge, Gumla.

The bail application of the petitioner was earlier rejected by this Court in B.A. No. 7540/2024 vide order dated 28.11.2024.

On 09.03.2023, the petitioner is alleged to have given lathi blow on the head of his wife due to which she succumbed to her injuries.

Ms. Soumya Pandey, learned counsel for the petitioner submitted that even considering the allegation to be true, prima facie, this case will be made out under Section 304 of the I.P.C. It was further submitted that the petitioner had given only one lathi blow on the head of the deceased and as such, it cannot be said that the petitioner had an intention to kill the deceased. It was also submitted that the petitioner is in custody since 27.03.2023.

In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge-I-cum-Special Judge, Gumla in connection with S. T. Case No. 207/2023 arising out of Palkot P.S. Case No. 10/2023 corresponding to G.R. No. 346/2023.
