This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 341, 323, 307 of the Indian Penal Code pending in the Court of ACJM, Hazaribag in connection with Korrah PS Case No. 259 of 2022.

Learned counsel for the petitioner submits that infact the informant came to the shop of this petitioner consumed tea but did not pay the price as a result of which when the petitioner demanded his money he was assaulted. Only to save his skin a false case has been lodged. He further submits that there was no intention to commit murder as the weapon used was iron rod and there is only one injury on the informant.

4. Learned A.P.P. representing the State opposes the prayer for anticipatory bail and submits that petitioner was assaulted and there is assault on the informant also.

After hearing the parties and after going through the records, I find that there is an allegation that the petitioner has assaulted the informant on the allegation that even inspite of receipt of money the petitioner did not served the tea to the informant which was objected by the informant. I have gone through the injury report, I find that there is one stitched

2025:JHHC:16214 wound on the person of the informant and from the FIR and the other materials which is available in the case-diary prima-facie ingredients of section 307 of the Indian Penal Code is missing. The other sections are bailable in nature.

6. Accordingly, this Anticipatory Bail Application stands disposed of.

7. The petitioner should appear before the concerned court and file appropriate application as per the law.
