Learned counsel for the petitioner submits that this interlocutory application has been filed with a prayer for early hearing of the instant bail application.

Since, the hearing of instant bail application is taken up today, hence, this interlocutory application stands rejected being infructuous.

The petitioner has been made accused in connection with Deoghar (Cyber) P.S. Case No.11 of 2025 registered under Section 318 (4), 319 (2), 338, 336 (3), 340 (2) and 61 (2) of the B.N.S., 2023 and Section 66 B, 66 C, 66 D and 84 C of the Information & Technology Amendment Act, 2008.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cybercrime and one mobile phone and two SIM Cards have been recovered from his possession and he has defrauded the victims Md. Nasiruddin and Shakil Ahemad to the tune of Rs.15,714/- and Rs.13,862/- respectively. It is submitted that the allegation against the petitioner is false. Drawing attention of this Court

towards para-10 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will transfer the amount allegedly defrauded to the bank account of the aforesaid victims without prejudice to his defence in this case. It is lastly submitted that the petitioner has been in custody since 25.01.2025 as is evident from para-12 of the instant bail application. Hence it is submitted that the petitioner be released on bail.

Learned Addl. P.P. opposes the prayer for bail.

Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on showing proof of transferring Rs.15,714/in the account of victim Md. Nasiruddin and transferring Rs.13,862/- in the account of the victim Shakil Ahemad without prejudice to his defence in this case and on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum Special Judge, Cyber, Crime Deoghar in connection with Deoghar (Cyber) P.S. Case No.11 of 2025 with

the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case .
