High Court of Jharkhand at Ranchi (Ambuj Nath, J.) — Common order dated 04.03.2025 allowing three bail applications (B.A No. 291 of 2025, with B.A No. 1123 of 2025 and B.A No. 1138 of 2025) arising out of the same police case, Deori P.S. Case No. 65 of 2024, registered under sections 309(6) of the Bharatiya Nyaya Sanhita, 2023 and pending before Ms. Nikhat Ayesha, Judicial Magistrate 1st Class, Giridih. Underlying incident: robbery at the informant's house on 30.07.2024 at about 8.00 p.m., in which Rs. 25,000/- and other household articles were looted. Counsel urged that the petitioners were neither named in the FIR nor put on T.I. Parade and that nothing incriminating was recovered from them, and that co-accused Bhola Singh and Rajesh Das had earlier been granted bail by this court; the State counsel opposed the prayer citing criminal antecedents (petitioners accused in two other cases). Heard the parties.

Petitioners have been made accused in connection with Deori P.S. Case No. 65 of 2024 for the offences registered under sections 309(6) of the Bharatiya Nyaya Sanhita, 2023, pending in the court of Ms. Nikhat Ayesha, learned Judicial Magistrate, 1^st Class, Giridih.

On 30.07.2024 at about 8.00 p.m., robbery was committed in the house of the Informant. Accused persons looted Rs. 25,000/- and other household articles.

It was submitted that the petitioners are neither named in the FIR, nor they were put on T.I. Parade. It was further submitted that nothing incriminating has been recovered from their possession. It was finally

submitted that co-accused Bhola Singh and Rajesh Das have been granted bail by this court earlier.

Mr. Vishwanath Roy, learned Special P.P, Mr. Abhay Kumar Tiwari and Mr. Anup Pawan Topno, learned A.P.P have opposed the prayer for bail and submitted that the petitioners are accused in two other cases

Considering the fact that apart from criminal antecedent of the petitioners, there is no other material against them, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) each, with two sureties of the like amount each, to the satisfaction of Ms. Nikhat Ayesha, learned Judicial Magistrate, 1^st Class, Giridih in connection with Deori P.S. Case No. 65 of 2024.
