Anticipatory Bail Application (A.B.A. No.218 of 2025, High Court of Jharkhand at Ranchi; Order No.02 dated 21-01-2025; Anil Kumar Choudhary, J.). Three family members of Village Kandedih, P.S. Topchanchi, District Dhanbad — Sanjay Kumar Mandal @ Sanjay Mandal (47), Rohit Kumar Mandal @ Rohit Mandal (19) and Sita Devi (40) — sought anticipatory bail apprehending arrest in Rajganj P.S. Case No.55 of 2024, instituted under Sections 191(2)/191(3)/127(2)/115(2)/118(1)/303(2)/109/351(2)/352 of the B.N.S., 2023. The allegation, as submitted by learned senior counsel, was that the petitioners were members of an unlawful assembly which, in prosecution of its common object, attempted to murder Rabindra Nath Mandal on the ground that his son married the daughter of petitioner No.1; the State and the informant opposed, urging that the petitioners might kill Soni Kumari (daughter of petitioner No.1) and her husband Akshay Kumar (son of the victim) if released. The Court rejected anticipatory bail for petitioner No.1 in view of the serious nature of the allegation against him and the chance of his being a threat to the members of the informant's side including his own daughter. Finding petitioner No.2 to be a 19-year-old student of R.S. More College, Govindpur and petitioner No.3 to be a female, the Court granted them anticipatory bail: surrender before the learned court below within six weeks, and enlargement on bail on depositing Rs.20,000/- cash security each and furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of learned C.J.M., Dhanbad, conditioned on co-operation with the investigation, appearance before the investigating officer as and when noticed, furnishing mobile numbers and Aadhar Card copies with an undertaking not to change mobile numbers, refraining from annoying or disturbing the informant, victim or their family members including Soni Kumari and Akshay Kumar, not going to or near the house of the informant/victim during the pendency of the case, and the further conditions laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
