1. The description of the land is as follows:-

“the land appertaining to Jamabandi No.27, Plot No.36, area 8 and ¾ decimals of land, Mouza Koriyasa, Thana No.396, Subdivision Deoghar”

2. Prima facie it appears that it is a case of civil dispute. The claim of the petitioner is contradictory. On the one hand, he is claiming title on basis of being the legal heir of the recorded tenant and on the other hand he is claiming on the basis of ‘Daan Patra’. Thereafter, plea of the consent has also been taken. These all are contradictory and it cannot be resolved by the Revenue Authority or by this Court under writ jurisdiction.

3. Accordingly, the present writ petition stands disposed of giving liberty to the parties to work out their remedies in accordance with law.
