The petitioners have filed this writ application for issuance of direction to the respondents for disposing of their application made for Intra-State Mutual Transfer in terms of Circular issued by the Primary Education and Literacy Department as amended vide Notification no. 1556 dated 08.06.2022 as contained in Sankalp Sankhya-6 (kha)(iv).

The petitioners were appointed as assistant teachers at the various places in the State of Jharkhand. In light of the Notification no. 1556 contained in Sankalp Sankhya-6 (kha)(iv), the petitioner nos. 1 & 2 namely Prabhu Prasad Verma and Subash Kumar Pandit have filed a representation for their mutual transfer from/to Giridih and Sahebganj, petitioner nos. 3 & 4 namely Amrit Rajwar and Kameshwar Kumar Das have filed representation for their mutual transfer from/to Dhanbad and Hazaribagh while petitioner nos. 5 & 6 Deepak Kumar Yadav and Dipak Kumar Mahato have file representation for their mutual transfer from/to Koderma and Dhanbad respectively.

It was submitted that respondents have not passed any order on their representation. It was further submitted that petitioners have to take care of their family and old parents and due to long travelling distance they are unable to do their work properly.

There is a provision for mutual transfer as per Clause 6 of the writ application in W.P.(S) No. 5821 of 2023 with the stipulation that the petitioners cannot claim as a matter of right.

Since no decision has been taken in this matter by the respondents, the petitioners knocked the door of this Court.

Learned counsel appearing on behalf of the respondents assured that a decision will be taken on the representation filed by the petitioners for their mutual transfer within four weeks from the date of receipt of this order.

In view of the assurance made above, the respondent no. 2 The Director, Primary Education and Literacy Department, Ranchi, Durwa, District Ranchi, Jharkhand is directed to dispose of the application filed by the petitioners for their mutual transfer within four weeks from the date of receipt of this order.

With this direction, this writ application is disposed of.
