The instant writ application has been preferred by the petitioner praying for a direction upon the respondentAuthorities to stay the departmental proceeding in connection with WJA/Murlidih 20/21 Pits/2023/127 till final decision in the criminal case being registered as R.C. Case No. 03(A)2023(D) which is pending before the learned Special Judge, Dhanbad.

Learned counsel for the petitioner, after some argument submits that atleast he may be given full opportunity before the departmental proceeding so that he

can put forth his contention and examine the witnesses.

Learned counsel for the respondent does not object the aforesaid contention of the petitioner.

Having regard to the aforesaid facts and circumstances of the case, the instant writ application is, hereby, disposed of by directing the respondent-authorities to proceed in the departmental proceeding in accordance with the rules and regulations of the respondent-BCCL and following the principal of natural justice. It is made clear that the respondents are directed to conclude the departmental proceeding as early as possible, preferably within a period of twelve weeks.

Accordingly, the instant writ application stands disposed of in the manner indicated hereinabove.
