Heard Mr. Manoj Kumar Choubey, learned counsel for the petitioner, Mr. Ranjan Pd. Sinha, learned counsel for the respondent no. 4 and Mr. Sachin Kumar, learned counsel for the respondent no. 5.

In this writ application, the petitioner has prayed for a direction upon the respondent no. 5 to hand over the land demarcated for playground to the respondent no. 4 for its development.

It has been stated in the writ application that the Executive Engineer, Housing Board, Jamshedpur through its letter dated 29.06.1989 bearing letter no. 1099 has submitted the map of the area in question of Adityapur-2 and an area of 141168 sq. feet was earmarked for playground situated near S. N. High School and Middle School, Adityapur. It has been stated that the plan was sanctioned by the respondent no. 5 for construction of 4205 house and 64 shops and the areas for school and playground and construction has accordingly been made in the land. It is the grievance of the petitioner that in spite of sanctioned plan, the area demarcated for playground in the year 1989 has

not been handed over to the respondent no. 4 for which representations were submitted before the concerned authorities for development and handing over of the playground.

Mr. Ranjan Pd. Sinha, learned counsel for the respondent no. 4 submits that he is unaware about such playground having been handed over to the respondent no. 4.

Be that as it may, the grievance of the petitioner will be looked into by the concerned authorities. The petitioner is therefore directed to approach the respondent no. 5 for redressal of his grievance along with all necessary documents and if the grievance of the petitioner is found to be genuine, the respondent no. 5 shall act upon the same accordingly.

In view of the observations made, this Public Interest Litigation stands disposed of.
