It appears that there is civil dispute between the parties and the Suit has been filed by the respondent Nos.5 and 6 for title and possession of

the said piece of land. Against which 1^st appeal being Civil Appeal No.27 of 2017 has been filed and that has been allowed in favour of private respondents. Thereafter, second appeal being S.A. No.195 of 2020 has been filed by the petitioner before this Court, which is still pending. In that view of the matter, the notice dated 04.01.2023 issued in online Land Measurement Case No.43 of 2019-20 by the respondent No.2, is nothing but misuse of the process of law and hence, it is not maintainable.

Accordingly, this writ petition is allowed and the notice dated 04.01.2023 issued in online Land Measurement Case No.43 of 2019-20 by the respondent No.2 is, hereby, quashed and set aside.

The parties are at liberty to execute the decree as per decision of the pending civil proceeding.
