2676 of 1994(R). Thus, the settlement in favour of the petitioner has continued. The rent receipt has been issued by the ex-landlord and subsequently, by the State of Bihar. It appears that thereafter, in spite of the mutation, the rent receipts are not being issued and as such, this petitioner approached this Court by filing a writ petition being W.P.(C) No. 1999 of 2020 which has been disposed of vide order dated 05.11.2020. The said writ petition was filed for deciding the representations dated 07.03.2014 and 05.09.2019. Operative portion of the said
order is quoted herein below:
“अिभलेख उप�थािपत। सूचना का तािमला ঋितवेदन ঋा� है। कायम जमाब�ीदार बने’वर पਔा िपता-नीलकਔ पਔा के वंशज मोतीलाल पਔा उप्�थत है। उ�ोने कायम जमाब�ी खाता नं0 260 �ॉट नं0 3986 एवं 3995 रकबा ॿमशः 0.03 एकड़ एवं 12.56 एकड़ के साশ के ॺप म७ सादा ॽবनामा उसका नोटरी प्�क �ारा िह�ी ॺपांतरण जमींदारी रसीद (साल 2000 एवं साल 2002) सरकारी रसीद (वष१ 1972,1988, 1991) ঋ�ुत िकया।
मुূ सिचव, झारखਔ राँची का पআांक-2074/ रा०, िदनांक 13.05.2016 िवभागीय पআांक-1704 िदनांक-15.07.2020 िवभागीय संक� संূ ा 6144 िदनांक-21.12.2017 एवं पআांक-2861 िदनांक 08.06.2017 म७ िनिहत िदशा िनद८श के अनुसार पु� ঋमाण नहीं है, मेरे �ारा �थालीय जाँच म७ आवेिदत भूिम पर आवेदक का दखल नहीं पाया गया। आवेिदत भूिम पर खेल मैदान पाया गया। आवेिदत भूिम पर ঋितवष१ ঋिस� ईंद मेला लगता है वहीं, एक पहानों का नाम युঢ प�रगड़ी है जो �थानीय लोगों का आ�था का ঋतीक है। आवेिदत भूिम पर एक आम रा�ा जो कालीकरण है गुजरता है। इस कालीकरण सडक के दिणी भाग म७ परती जमीन है उसपर भी आवेदक का दखल नहीं पाया गया।
उঢ िवभागीय पौरपআों एवं �थालीय जाँच म७ जमाब�ी संदेहा�द ঋतीत होता है। अतः उঢ जमाब�ी को िनयिमत नहीं िकया जा सकता है।“
