1. The present writ petition has been filed claiming that village public road has been encroached. Although the allegation is against respondent No.5, but no notice is required to be issued upon him in view of the order to be passed.

2. It has been submitted by the learned counsel for the petitioner that Misc. Case No.96 of 2020, under Section 133 of Cr.P.C, is pending before respondent No.03.

3. In that view of the matter, the present writ petitioner is, hereby, disposed of directing the petitioner to pursue his remedy in the pending proceeding. The respondent No.03, i.e., S.D.O, Garhwa, is directed to dispose of the pending proceeding, if not already disposed of, as quickly as possible, preferably within three months from the date of receipt/ production of copy of this order.

4. It is clarified that the order should be passed after hearing all the affected parties and after following due process of law.
