Heard the parties.

The petitioner has filed this writ application for quashing of letter No. 944 dated 02.06.2006 (Annexure-6) issued by the respondent No.5 the District Superintendent of Education, Giridih, whereby the services of 32 teachers were terminated on the ground that the Teachers Training Certificates of the teachers were found to be forged and fabricated. The service of the petitioner was also terminated by the aforesaid letter.

The case of the petitioner is that he was declared to be successful by J.P.S.C., Ranchi alongwith 487 other students for appointment as trained teachers in the year 2003 and he joined the primary school, Padaniya, Gandey on 21.09.2004 on the post of Assistant Teacher and worked on that post for one year nine months. When the documents of the petitioner was verified, it was found that the certificate furnished by him

that he has passed B.Ed Examination from the Mahatma Buddha Primary Teacher Education College, Motipur, Muzaffarpur was forged and fabricated.

The respondents have filed their counter affidavit. They have stated that after verification, the teachers training certificate which was furnished by the petitioner was found to be forged and fabricated and as such, the service of the petitioner was terminated by the respondent No.5 the District Superintendent of Education, Giridih vide letter No.944 dated 02.06.2006.

As the petitioner had managed to procure employment as Assistant Teacher by using forged Teachers Training Certificate, his service was rightly terminated.

No case for quashing of letter No. 944 dated 02.06.2006 (Annexure-6) is made out. Accordingly, this writ application is dismissed.
