16 / 15.03.2024 Appellants are apprehending their arrest in connection with Kunda P.S. Case No. 40 of 2015 corresponding to G.R. No. 984 of 2015 and SC/ST Case No. 117 of 2016 for the offences registered under sections 147, 148, 149, 323, 452, 504 and 506 of the Indian Penal Code read with section 3(1)(x) of SC/ST (Prevention of Atrocities) Act, pending in the court of learned Additional Sessions Judge, 1^st cum Special Judge, Deoghar.

It is alleged that appellants were trying to dispossess the Respondent No. 2 from the land appertaining to Plot Nos. 908 and 909 who is member of SC/ST community.

It was submitted that initially, complaint case was lodged by the Respondent No. 2 and final form was submitted by the police. It was further submitted that Respondent No. 2 has filed a protest petition which was converted into complaint case. After inquiry, process was issued under section 204 of the Cr. P.C.

Considering the fact that the police at the first instance had submitted final form in this case, appellants, above named, are directed to surrender before the learned court below within two weeks from the date of receipt of this order and the learned court below shall release them on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty-five thousand) each, with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge, 1^st cum Special Judge, Deoghar in connection with Kunda P.S. Case No. 40 of 2015 corresponding to G.R. No. 984 of 2015 and SC/ST Case No. 117 of 2016, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
