The instant revision petition has been filed against the order dated 16.04.2019 passed in Cr. Misc. Petition No. 36/2019 by which the period of extension for surrender before the court below was rejected.

The petitioners were earlier granted anticipatory bail vide order dated 30.07.2018 in A.B.P. No. 737 of 2018 with a direction to surrender before the court below within two weeks of the order. The petitioners did not surrender before the court below in compliance to the direction and filed extension petition on 15.04.2019 after about ten months of the order.

It is submitted by learned counsel for the petitioners that the petitioners had no knowledge about passing of the anticipatory bail order in their favour and, therefore, they could not surrender within stipulated time of two weeks.

Learned counsel for the State has defended the impugned order and submitted that there is no merit in the submission advanced on behalf of the petitioners that they had no knowledge about the order being passed in anticipatory bail petition in their favour.

It is not a case of delay by a month or two month after passing of the said order. The petitioners filed extension petition almost about ten months after the said order of surrender. The delay in surrender has resulted in delay in adjudicatory process which cannot be granted as a premium by allowing such revision petition. The revision petition is accordingly rejected.

The petitioners are directed to surrender before the court below within two weeks and file regular bail which will be considered by the Court below without being prejudiced by the order of this Court.
