This interlocutory application has been preferred under Section 21(5) of the National Investigation Agency Act for condoning the delay of 41 days in preferring the instant criminal appeal.

Considering the sufficient cause as has been referred in the interlocutory application and having no objection on the part of the Respondent State and also the fact that delay is not beyond the period of 90 days, the delay of 41 days in preferring the appeal is hereby condoned.

The instant criminal appeal filed under Section 21(4) of the NIA Act, 2008 is directed against the order dated 20.03.2024 passed in Misc. Criminal Application No. 3443 of 2023 by the court of learned AJC-XVI cum Spl. Judge, NIA, Ranchi in connection with Special NIA Case No. 03 of 2018 arising out of Tandwa P.S. Case No. 02 of 2016 corresponding to R.C. Case No. 06/2018/NIA/DLI for the offence registered under Section 414, 384, 386, 387, 120B of the IPC; under Section 25(1-b)a, 26,35 of the Arms Act ; under Section 17(1)(2) of the

Learned counsel for the respondent -NIA has submitted by referring to statements made at para 11 of the counter affidavit that the case is at the fag end and at the stage of 313 Cr.P.C.

In view thereof, learned counsel for the appellant does not seek to press the appeal.

Accordingly, the instant appeal is dismissed as not pressed and consequently disposed of.
