By the Court:- Heard the parties.

Though notice has validly been issued to the opposite party No.2 yet no one turns up on behalf of the opposite party No.2 in spite of repeated calls.

This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 482 of the Code of Criminal Procedure with a prayer to quash and set aside the order dated 03.04.2019 by which bail bond of the petitioners were cancelled and non-bailable warrant of arrest has been issued against them by the learned Judicial Magistrate, Giridih vide order dated 19.05.2022 in connection with Complaint Case No.1478 of 2013.

Learned counsel for the petitioner submits that though this Cr.M.P. has been filed for quashing the order dated 03.04.2019 by which the bail granted to

the accused persons has been cancelled and non-bailable warrant of arrest has been ordered to be issued against them but the petitioners modify their prayer and submit that they will surrender before the trial court within three weeks from the date of this order and will pray for regular bail; after appearance of all the accused persons of the case, in the trial court.

Considering the aforesaid facts this Cr.M.P. is disposed of with a direction to the learned trial court that in case the petitioners surrender before the trial court within three weeks from the date of this order and pray for regular bail after appearance of all the accused persons of the case; then the learned trial court will consider the same and release the petitioners on bail on furnishing bail bonds of Rs.25,000/- with two sureties, with any other condition it deems fit.

Accordingly, this Cr.M.P. stands disposed of.
