Constructions Private Limited [hereinafter referred to as the Company]. He submits that the petitioners are the Director and employee of the said company. He further submits that the work was executed in accordance with the designs, maps and on the exact site of the land, as provided by the Executive Engineer, Road Construction Department, Road Division, Sahibganj. He submits that General Clause-21, SubClause-1 of the conditions of the contract, as laid down in the agreement was the site plan. He submits that on all the requisites permission of any kind whatsoever were to be obtained by the Road Construction Department. He also submits that only allegations are made that certain filling of earth was done manually by some men of the company without any permission from the forest department. He submits that the said company has already completed the said project and the Executive Engineer of the said department has issued the completion certificate on 26.02.2014 itself in favour of the company. 25. Learned counsel appearing for the petitioners draws the attention of the court to the documents brought on record by way of filing I.A. No. 3378 of 2022 in Cr.M.P. No. 2652 of 2016. By way of referring Annexure-I.A.-2 he submits that by letter No. 121 dated 17.01.2013, the District Forest Officer, Sahibganj Forest Division, Sahibganj accorded the approval for failing of trees in course of strengthening and widening of Borio-Tinpahar-Rajmahal Road, which itself indicates that responsibility of obtaining one or other statutory clearances was on the use agency, i.e. the Road Construction Department, Road Division, Sahibganj and the same is also reflected from Clause-21(1) of the general conditions of contract marked as Annexure-2 to the quashing petition. He further refers to AnnexureI.A.-3 of the said I.A. and submits that by letter No. 311 dated 09.02.2013, the Divisional Manager, Minor Forest Produce Division, Giridih also wrote to the Executive Engineer, Road Construction Department, Sahibganj detailing therein the mode of failing of trees necessary for widening and strengthening of the said road.
