2. Learned counsel for the opposite party- State is also present.
3. This criminal miscellaneous petition has been filed for restoration of Cr. Revision No. 475 of 2023 which stood dismissed for non-compliance of order dated 22nd June 2024 by which the peremptory time was granted to remove the surviving defects.
4. Learned counsel for the petitioner submits that the petitioner has already surrendered and is in custody. He submits that the revision be restored to its original file, failing which the petitioner will suffer irreparable loss and injury.
5. Learned counsel for the opposite party- State has no objection to the prayer made.
6. Considering the submissions, this criminal miscellaneous petition is allowed and Cr. Revision No. 475 of 2023 is restored to its original file.
7. Liberty is reserved with the petitioner to mention Cr. Revision No. 475 of 2023 before appropriate Bench as per roster.
