05/19.07.2024 The present contempt petition has been filed for initiating a contempt proceeding against the contemnors/opposite parties alleging wilful disobedience of order dated 02.11.2023 passed in W.P.(S) No. 5084 of 2023.

2. Pursuant to the order dated 22.06.2024, Dr. Ram Kumar Singh, Vice-Chancellor, Binod Bihari Mahto Koylanchal University, Dhanbad and Dr. Kaushal Kumar, Registrar of the said University, are physically present before this Court.

3. A show cause affidavit has also been filed on behalf of

the opposite party nos. 2 and 3 on 18.07.2024.

4. Mr. Manish Kumar, AC to Mr. A.K. Mehta, learned counsel for the opposite party-University, refers to paragraph nos. 7

and 8 of the show cause affidavit dated 18.07.2024, which read as

“7. That immediately upon receipt of funds from the State Government, the University took steps to release arrear of enhanced gratuity, i.e. Rs.10 Lakh to the petitioner along with other similarly situated teachers of the University.

8. That the University has sanctioned release of Rs.10 Lakh in favour of the petitioners by 5 separate Sanction Orders dated 27.06.2024. On the same day, the aforesaid amount has also been transferred to individual bank accounts of 4 petitioners while arrear gratuity of petitioner no. 4 has been transferred in the Bank Account of his wife Malti Devi as he died during pendency of this case.”

5. It is thus submitted that the aforesaid order of this

Court has now been complied.

6. Learned counsel for the petitioners also accepts that

the aforesaid order has now been complied by the opposite party no. 2.

7. Considering the said fact, there is no need to further proceed in the matter. The contempt proceeding as against the opposite parties is hereby dropped.

8. The contempt petition is accordingly disposed of.
