The applicant who is in custody since 25.11.2022 has renewed his prayer for grant of regular bail in connection with S.T. No.152 of 2023 arising out of Barhait P.S. Case No.133 of 2022, corresponding to G.R. Case No.136 of 2023, registered for the offence under Sections 302/ 307/201/120-B/34 of IPC and Section 27 of the Arms Act, pending in the court of learned Additional Sessions Judge-III, Sahibganj.

Earlier the prayer for bail of the applicant(s) has been rejected twice by this Court, lastly on 09.11.2023 passed in B.A. No.7986 of 2023.

Innocence has been claimed and participation in the trial has been assured. It has been submitted that the husband of the deceased, who is an eye witness, has been declared hostile by the prosecution. Further similarly situated co-accused has already been enlarged on bail by this Court vide order dated 26.07.2024 passed in B.A. No.6368 of 2024. On the above facts, prayer for bail has been renewed.

On the other hand, learned A.P.P. has opposed the prayer for bail.

Considering the above facts, I am inclined to enlarge the applicant (s) on bail. Accordingly, the applicant(s), above named, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the court below, on the condition that the applicant(s) will submit self-attested photocopy of his/her/their Aadhaar Card(s) and also submit his/her/their mobile number(s) before the learned court below which he/she/they will always keep active and will not change it during pendency of this case without prior permission of the court.
