Heard learned counsel for the petitioner and the learned A.P.P. appearing on behalf of the State.

The petitioner is an accused in connection with Ghatshila P.S. Case No. 33 of 2024, dated 24.06.2024, for the offence registered under Sections 461 and 379 of the Indian Penal Code and the case is pending in the Court of learned Additional Chief Judicial Magistrate, Ghatshila.

It is submitted on behalf of the petitioner that the allegations as set out in the F.I.R. is that the petitioner alongwith the co-accused persons had committed theft in the liquor shop of the informant alongwith the co-accused persons and took out a sum of Rs.3,10,000/- from the locker of the shop.

Learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R. and his name has appeared in this case on the basis of the confessional statement of the co-accused who was apprehended in another case and later on this petitioner is also said to have confessed his guilt in his confessional statement and on the basis of his confessional statement one Toyota Qualis vehicle was recovered which is said to have been used in the commission of the offence.

Learned counsel for the petitioner has further submitted that the petitioner is in jail since 13.07.2024 and in the earlier four cases instituted against this petitioner he is on bail and he is running a scrap shop ( Kabari Shop) and therefore, he deserves to be enlarged on bail.

On the other hand the learned A.P.P. appearing on behalf of the State has opposed the contentions raised on behalf of the petitioner and submitted that the petitioner is a man of criminal antecedent and has four cases pending

against him and he is a habitual offender and therefore, he does not deserve to be enlarged on bail.

Having heard the parties, perused the records of this case.

In the light of the persuasive submissions advanced on behalf of the parties and under the facts and circumstances of this case, the petitioner hereinabove is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-five thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Additional Chief Judicial Magistrate, Ghatshila, in connection with Ghatshila P.S. Case No. 33 of 2024, subject to the condition that the petitioner will appear before the learned Court below on each and every date as and when required, failing which, appropriate order shall be passed by the learned Court below for the cancellation of the bail as per the provisions of law.
