The counter-affidavit filed on behalf of State is taken on record.

This bail application has been filed on behalf of the applicant– Aman Kumar Dubey with prayer to release on bail in connection with Adityapur P.S. Case No. 113 of 2024 registered under sections 17(b)/21(b)/25 of N.D.P.S Act, pending in the court of learned Sessions Judge, Seraikella-Kharsawan at Seraikella.

The FIR of this case was lodged against the two named accused Ashtomi Devi and Aman Dubey wherein the allegations are made that from the room of Ashtomi Devi 26 pouch of brown sugar were recovered which were verified by drug detecting kit and on being weighed it was 3.86 grms, while from the possession of Aman Dubey, 6 pouch brown sugar was recovered and from being weighed, it was 0.73 grms.

The brown sugar which is alleged to have been recovered from the possession of the petitioner is of small quantity. Similarly situated coaccused Ashtomi Lohar @ Ashtami Lohar @ Ashtomi Devi has been granted bail in B.A. No. 5912 of 2024 vide order dated 27.08.2024 by coordinate Bench of this Court.

The learned APP for the State admits parity.

The petitioner has been languishing in jail since 11.04.2024 having no criminal antecedent.

In view of the above, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
