Both these bail applications arise out of the same police case and as such, these bail applications are being disposed of by this common order.

The petitioners have been made accused in connection with Jamua P.S. Case No. 37 of 2024, S.T. Case No.284 of 2024, for the offences registered under Sections 323/341/365/498(A)/506/304(B)/201/34 of the Indian Penal Code and Sections 3 / 4 of D.P. Act, pending in the court of Sri Rajesh Kumar Bagga, learned Additional Sessions Judge-IX, Giridih.

The petitioners Samila Khatun and Md. Rafik are the mother-in-law and father-in-law of the deceased and the petitioners Guddu Khan and Md. Salauddin are the in-laws of the deceased. The deceased was garroted to death in her matrimonial home and her dead body was thrown in a nearby forest.

It appears that on the basis of confession of the petitioner Guddu Khan, the dead body of the deceased was recovered, whereas on the basis of confession of petitioner Samila Khatun, the clutch wire used in the murder of the deceased was recovered.

It was submitted that as far as Md. Rafik and Md. Salauddin are concerned, there is general allegation against them and nothing incriminating was recovered on their confession.

In view of the aforesaid fact, I am not inclined to release the petitioners Samila Khatun and Guddu Khan, on bail. Accordingly, their prayer for bail is hereby rejected.

As far as petitioners Md. Rafik and Md. Salauddin are concerned, I am inclined to release the petitioners Md. Rafik and Md. Salauddin, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of Sri Rajesh Kumar Bagga, learned Additional Sessions Judge-IX, Giridih, in connection with Jamua P.S. Case No. 37 of 2024, S.T. Case No.284 of 2024.
