Heard learned counsel for the petitioner and learned APP for the State.

This bail application has been filed on behalf of the abovenamed petitioner with prayer to release on bail in connection with Ghatsila P.S. Case No.110 of 2022 registered under sections 406, 420, 467, 468, 34 and 120-B of I.P.C., pending in the court of learned ACJM, Ghatsila.

The FIR of this case was lodged by the Panchayat Secretary, Kalchiti Gram Panchayat with these allegations that after preliminary enquiry being made in regard to MANREGA Scheme, it came to know that Rojgar Sewak, MANREGA, namely, Arun Kumar Gorai, the petitioner herein had not made payment to the labourers as shown in muster roll rather it was paid to another person. The Block Development Officer, Ghatsila was also apprised in regard to said enquiry report and after enquiry, it came to know that Arun Kumar Gorai, Rojgar Sewak had not made payment of wages to the Job Card holder, hence made criminal breach of trust.

The petitioner is the employee of MANREGA. The payment, which is alleged to have been made by him not in favour of Job Card holder rather against the other persons and the same is based on preliminary enquiry as alleged in the FIR itself. Admittedly, the enquiry report has not made part of the case diary as submitted by the learned APP for the State.

In view of the above, the bail application of the petitioner is hereby allowed. Let the petitioner be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty thousand) with two sureties of like amount to the satisfaction of the court concerned in the aforesaid case.
