05 /12.04.2024 Heard the learned counsel for the petitioner, learned counsel for the Informant as well as the learned counsel for the respondent State.

The petitioner is apprehending his arrest in connection with Meharma P.S. Case No. 111 of 2023, for the offence registered under Sections 341, 342, 376(3) of Indian Penal Code and Section 4 of the POCSO Act, pending in the court of learned Additional Sessions Judge-I-cum-Spl. Judge, POCSO, Godda.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. He submits that the petitioner is only accomplice of the main accused and in view of that the privilege of anticipatory bail may kindly be provided to the petitioner.

Learned counsel appearing for the State opposed the prayer and submit that the victim is aged about 13 years and there is direct allegation against the petitioner. 5. Learned counsel appearing for the Informant accepts the submission of the learned counsel appearing for the State.

Considering that victim was aged about 13 years and there is direct allegation against the petitioner of holding the victim and prima facie case under Section 376 and POCSO Act are made out. 6. In the attending facts and circumstances, I am not inclined

to grant privilege of anticipatory bail to the petitioner, and hence, the prayer for anticipatory bail of the petitioner, is, hereby, rejected. Accordingly, this anticipatory bail application is hereby dismissed.
