Single-judge bail order of the High Court of Jharkhand at Ranchi in B.A. No.5986 of 2024 (Subhash Chand, J., decided 04.09.2024). Petitioner Shivam Kumar Hajam sought bail in Namkum P.S. Case No.194 of 2024(N) under Sections 17(B)/22/25/29 of the NDPS Act, arising from a secret-information raid near village Machuwa on Jareya road in which co-accused Shanicharwa Munda @ Charo and Deepak Munda @ Jagru were caught with 200 gram opium and the petitioner was apprehended with 500 gram opium on their disclosure. Court found the 500 gram recovery to be from the joint possession of the petitioner and co-accused Arun Kumar, i.e., below commercial quantity, noted custody since 26 May 2024 and absence of criminal antecedent, and allowed bail subject to a bond of Rs.25,000/- with two sureties of the like amount.
