04/02.04.2024 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Gumla P.S. Case No. 238 of 2020 (G.R. No. 719 of 2020), registered under Sections 341, 342, 504, 506, 34 of the I.P.C. and under section 3/4 of Witchcraft Practices Act, pending in the Court of learned Chief Judicial Magistrate, Gumla.

Learned counsel for the petitioner submits that the case was investigated by the police and final form has been submitted in which the petitioner has not been sent up for trial however, the learned Court has been pleased to take cognizance by order dated 22.10.2020. He further submits that the co-accused has been granted privilege of anticipatory bail by this Court in A.B.A. No.384 of 2024.

Learned counsel for the State opposes the prayer for anticipatory bail on the ground that the learned Court has rightly taken cognizance.

Considering that the case was investigated by the police and final form has been submitted in which the petitioner has not been sent up for trial however, the learned court has been pleased to take cognizance by

order dated 22.10.2020, the word ‘cognizance’ has been filled up in blank space and also considering that the co-accused person has been granted privilege of anticipatory bail in the said A.B.A., I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his surrender/arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of the Chief Judicial Magistrate, Gumla, in connection with Gumla P.S. Case No. 238 of 2020 (G.R. No. 719 of 2020), subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure and the petitioner will not change his mobile number which is indicated in his Aadhar.
