Heard both the sides.
The petitioner- Wakil Choudhary is in custody since 09.03.2023 in connection with Godda (M) P.S. Case No. 46 of 2023 corresponding to G.R. No.749 of 2023 for the offence registered under Sections 25(1-B)(a)26/35 of the Arms Act pending in the Court of Chief Judicial Magistrate, Godda.
Earlier bail application of this petitioner was rejected on merit vide order dated 04.07.2023 and the instant petition has been renewed on the ground that the petitioner is in custody for more than one year and not a single witness has been examined till date.
Learned A.P.P. opposed the prayer for bail.
Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
