Heard learned counsel for the petitioner and the learned A.P.P. appearing on behalf of the State.

The petitioner is an accused in connection with Kolebira P.S. Case No. 88 of 2023 dated 27.12.2023, registered under Sections 414/34 of the Indian Penal Code, under Sections 25(1-B)a/26/35 of Arms Act, under Section 17 of C.L.A. Act subsequently charge framed under Section 414/34 of I.P.C., under Section 25(1-A), 35, 26(2) of Arms Act and under Section 17(i) of C.L.A. Act subsequently S.T. Case No. 30 of 2024, pending in the Court of Learned Sessions Judge, Simdega.

As per the allegations disclosed in the F.I.R. are that the petitioner along with co-accused person was apprehended by the Police and one country made pistol, two live cartridges and four pamphlets have been recovered from the possession of the petitioner. It has been pointed out on behalf of the petitioner that this petitioner is in jail since 28.12.2023 and charge has been framed in this case in connection with S.T. Case No. 30 of 2024 and the similarly situated co-accused person namely Deolal Singh @ Deo Kumar Singh who was also apprehended on the spot and some incriminating articles were also recovered from his possession has been enlarged on bail by the co-ordinate bench of this court vide B.A. No. 3208 of 2024 dated 27.06.2024 and therefore this petitioner deserves to be enlarged on bail who was also having criminal antecedent as this petitioner.

On the other hand, the learned A.P.P. appearing on behalf of the

State has opposed the contentions raised on behalf of the petitioner and submitted that this petitioner has four criminal antecedent while the coaccused person who has been granted bail was having three criminal antecedent although she did not controvert this fact that co-accused namely Deolal Singh @ Deo Kumar Singh has been enlarged on bail by the coordinate bench of this court and charge in this case has been framed.

Having heard the parties, perused the records of this case.

In the light of the submissions advanced on behalf of the petitioner and under the facts and circumstances of this case, this petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty-five thousand) with two sureties of the like amount each to the satisfaction of the Court of Learned Sessions Judge, Simdega, in connection with Kolebira P.S. Case No. 88 of 2023, subject to the condition that the petitioner will cooperate in the criminal proceeding pending in the learned Trial Court and he will remain present on each and every date of the criminal trial as and when required, failing which, appropriate order shall be passed by the learned Court below for the cancellation of the bail as per the provision of law.
