---4 /18.03.2024 Heard the learned counsel for the petitioner as well as the learned counsel for the respondent State.

The petitioner is apprehending his arrest in connection with Gumla P.S. Case No.339 of 2023, for the offence registered under sections 379, 411, 414, 120(B), 34 of the IPC, pending in the court of learned Chief Judicial Magistrate, Gumla.

Learned counsel for the petitioner submits that the allegations are made that three motorcycles were recovered from the house of this petitioner. He submits that the said motorcycles were kept by one of the friend of this petitioner and the petitioner is a lady and she is a student of B.A. Part-II and to buttress his such argument, he refers to Annexure-2 which is the I.Card of the College namely Kartik Oraon College, Gumla.

Learned State counsel opposed the prayer on the ground that three motorcycles were recovered from the house of this petitioner.

Considering that the petitioner is a lady and she is a student and doing her studies in B.A. Part-II from Kartik Oraon College, Gumla and Annexure-2 is the document which suggest that she is a student and it has been further pointed out that the said motorcycles were kept by her friend, and in the attending facts and circumstances, I am inclined to provide privilege of anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Gumla, in connection with Gumla P.S. Case No.339 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
