The petitioner is apprehending his arrest in connection with Jamtara Cyber Crime P.S. Case No.71 of 2023 registered under Sections 414/419/420/467/468/471/120B of the Indian Penal Code and Sections 66(B)/66(C)/66(D) of the I.T. Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged. As per the allegation, co-accused-Shams Tabrez Ansari was apprehended by the police, who allegedly disclosed the name of the petitioner and co-accused-Shams Kumar Ansari @ Mastan @ Samsh Kumar Ansari as the persons who were also involved in cybercrime. The police also allegedly seized four mobile phones from the place of occurrence out of which two mobile phones are said to be of the petitioner. In fact, the petitioner has no concern with the said seized mobile phones. He has been implicated in this case merely on suspicion without any cogent material. Similarly situated co-accused-Shams Kumar Ansari @ Mastan @ Samsh Kumar Ansari has already been granted anticipatory

bail by this Court vide order dated 4^th September, 2024 passed in A.B.A. No.553 of 2024. The petitioner has no criminal antecedent as has been stated in paragraph no.11 of the present anticipatory bail application. He also undertakes

co-operate in ongoing investigation of the case. Hence, he may be given the privilege of anticipatory bail.

Learned A.P.P. opposes the petitioner’s prayer for anticipatory bail and submits that the name of the petitioner surfaced in the present case on the alleged confessional statement of coaccused-Shams Tabrez Ansari. He, however, submits that the SIMs used in the mobile phones said to be of the petitioner were not found registered in his name.

Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs.20,000/(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Jamtara in connection with Jamtara Cyber Crime P.S. Case No.71 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
