03/06.09.2024 Heard the Parties.
The petitioner has been made accused in connection with Angara P.S. Case No. 32 of 2023, for the offence under Section 394 of the Indian Penal Code, pending in the court of Ms. Nutan Ekka, learned Judicial Magistrate, Ranchi.
Bail application of the petitioner has been earlier rejected by this court vide B.A. No. 8474 of 2023 vide order dated 30.10.2023.
On 16.05.2023 at about 9:30 A.M, three unknown persons intercepted the informant near Chamgati and snatched away his motorcycle. It appears that looted motorcycle was recovered from the possession of the petitioner.
Learned A.P.P has submitted that the petitioner was also put on T.I. Parade and he has been identified as one of the miscreants by the informant. Petitioner has got criminal antecedent.
Report regarding the stage of the trial earlier called for has been received. It appears that the case is still pending at the stage of framing of charge.
Considering the aforesaid fact and in view of the overwhelming evidence available against the petitioner, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail is hereby, rejected.
Learned trial Court shall take all possible steps to frame charge and conclude the trial.
