The petitioner is apprehending his arrest in connection with Sukhdeonagar (Pandra O.P.) P.S. Case No.190/2023 (G.R. No.2032/23), registered for the alleged offence under Section 147, 148, 149, 448, 341, 323, 427, 387, 379, 506 and 120(B) of the Indian Penal Code, pending in the Court of the learned Judicial Magistrate-III, Ranchi.

Learned counsel for the petitioner submits that no amount was paid in reference to the land to the petitioner. He submits that the petitioner is falsely implicated in the case on suspicion. He further submits that the petitioner is Khatiani Raiyat and there is dispute with regard to the land for which Original (Title) Suit No.2121 of 2019 is pending between the parties. He also submits that the co-accused has been provided privilege of anticipatory bail by a Coordinate Bench of this Court in A.B.A. No.9591 of 2023.

Learned counsel for the State opposed the prayer on the ground that the allegation of demand of money is there.

Considering that the co-accused, in the identical situation, has been

provided privilege of anticipatory bail in the aforesaid A.B.A. and one original title suit is pending with regard to the land in question between the parties and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-III, Ranchi in connection with Sukhdeonagar (Pandra O.P.) P.S. Case No. 190/2023 (G.R. No.2032/23), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
