Singray Chutia Purty Alias a.C.Singray Vs the State of Jharkhand

The petitioner is an accused in connection with Murhu P.S. Case No. 69 of 2023 dated 28.11.2023, registered under Sections 302/201/34 of the Indian Penal Code, pending in the Court of Learned S.D.J.M. at Khunti.

It is submitted on behalf of the petitioner that as per the allegation set out in the F.I.R., the petitioner along with co-accused persons have killed the Panda Bodra-son of the informant and also friend of the Panda Bodra i.e. Sebeyan Hapadgara. It is submitted on behalf of the petitioner that the similarly situated co-accused persons namely Lenga Purti & Sanika Purti have been enlarged on bail vide B.A. No.4315 of 2024 & B.A. No. 4514 of 2024 dated 31.08.2024 by the co-ordinate Bench of this Court and the case of the petitioner stands on the similar footing. It has further been submitted that there is no eye-witness in this case and only on suspicion, this petitioner has been implicated in this false case. Further, it has been pointed out that it is an admitted case of the prosecution that the deceased was a habitual drunkard and he used to take country-made liquor as evident from the contents of the F.I.R. itself and therefore, the possibility of accidental death cannot be ruled out. Further, it has been submitted that this petitioner is in jail since 29.11.2023. It is submitted that there is no criminal history against this petitioner. Charge-sheet in this case has been submitted and therefore possibility of tampering the evidence is very remote

and therefore, he deserves to be enlarged on bail.

On the other hand, the learned A.P.P. appearing on behalf of the State has opposed the contentions raised on behalf of the petitioner and submitted that the petitioner along with the co-accused persons is involved in double murder case but learned APP did not controvert this fact that similarly situated co-accused persons namely Lenga Purti & Sanika Purti has been enlarged on bail by the co-ordinate bench of this Court .

In light of the forceful submission advanced on behalf of the petitioner and under the facts and circumstances of this case, this petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/(Rupees Twenty-five thousand) with two sureties of the like amount each to the satisfaction of the Court of Learned S.D.J.M. at Khunti, in connection with Murhu P.S. Case No. 69 of 2023, subject to the condition that the petitioner will cooperate in the criminal proceeding pending in the learned Trial Court and he will remain present on each and every date of the criminal trial as and when required, failing which, appropriate order shall be passed by the learned Court below for the cancellation of the bail as per the provision of law.
