05/01.08.2024 The petitioner is apprehending his arrest for the offences punishable under Sections 272/273 of the Indian Penal Code and Section 47(a) of the Bihar (now Jharkhand) Excise Act, 1915.

2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. There is alleged recovery of 30 litres of illegal mahua liquor kept in a plastic jar from a gumti/shop which is said to be of the petitioner. It is further submitted that the petitioner has no concern either with the said gumti/shop or allegedly recovered mahua liquor from there. Moreover, the seizure list does not bear signature of any independent witness. The petitioner has no criminal antecedent as has been stated in paragraph no. 15 of the present application. He, however, undertakes to co-operate in the ongoing investigation. Hence, he may be given the privilege of anticipatory bail.

3. Learned A.P.P opposes the petitioner’s prayer for anticipatory bail.

4. Having heard learned counsel for the parties, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner above named, in the event of his arrest/surrender

within three weeks from today, shall be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Seraikella in connection with Adityapur P.S. Case No. 222/2023, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
