Heard the learned counsels for the parties.

The petitioner is an accused in connection with Namkum P.S. Case No. 157 of 2016 corresponding to G.R. No. 3280 of 2016 registered under sections 419/420 of the Indian Penal Code pending in the Court of learned J.M., Ranchi.

The learned counsel for the petitioner has submitted that petitioner was apprehended in connection with an examination in which the petitioner was meant to give examination, however he arranged someone else to impersonate him and that is why he has been dragged into this case. The learned counsel for the petitioner has further submitted that for the allegations he has been in custody from 17.12.2023 and he has already spent sufficient time in custody and the case is triable by a court of Magistrate and the maximum sentence is of three years and, therefore, he may be allowed the privilege of bail. Counsel has also stated that the charges have also been framed.

Learned counsel for the State, on the other hand, has opposed the bail petition and submitted that the allegations pertain to malpractice in examination for recruitment for typist in the Hon'ble Jharkhand High Court itself . Counsel has further pointed out from the impugned order that the coaccused Rajnesh Singh who has been impersonating, has also been held guilty and convicted and sentenced also for the offence under sections 414/420 and 120B IPC. It is further submitted that the appeal of Rajnesh Singh i. e. Criminal Appeal No. 158 of 2019 has also been dismissed. It is further submitted that co-accused Rajnesh Singh has also been held guilty, convicted and sentenced also for the offence under section 120B IPC not with any other person with the present petitioner, therefore, the petitioner does not deserve bail.

Having heard both counsels, gone through the records of the case and in the facts and circumstances of the case, I am not inclined to release the petitioner, named above, on bail, at this stage.

Accordingly, the bail application of the petitioner, above named, is rejected, at this stage.
