Petitioner is apprehending his arrest in connection with Jamtara Cyber Crime P.S. Case No.06 of 2024 for the offences registered under Sections 414, 419, 420, 467, 468, 471 and 120-B of the Indian Penal Code and sections 66(B), 66(C) and 66(D) of the Information Technology Act, pending in the court of learned Additional Sessions Judge-I, Jamtara.

Learned counsel for the petitioner submitted that case of petitioner is at par with co-accused Basudev Mandal who has already been admitted to anticipatory bail in ABA No.2396 of 2024. He has further submitted that it has been alleged by apprehended co-accused persons that this petitioner along with two other coaccused persons namely, Basudev Mandal and Nijamuddin Ansari fled away. Learned counsel is fair enough to make submission before this Court that anticipatory bail application of Nijamuddin Ansari has been declined by this Court on the premise that he is having criminal antecedent.

Learned APP for the State opposed the prayer of anticipatory bail of the petitioner.

Perusal of record transpires that as far as allegation qua this petitioner is concerned that is at par with Basudev Mandal who has already been admitted to anticipatory bail by co-ordinate Bench of this Court in ABA No.2396 of 2024 as counter affidavit filed on behalf of State reveals that petitioner is having no criminal antecedent.

Considering the aforesaid facts and circumstances of this case, this Court is inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, petitioner, above named, is directed to surrender before the learned Court below within four weeks from the date of receipt of a copy of this order and the learned court below on his surrender, shall release him on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten thousand) with two sureties of the like amount each,

to the satisfaction of learned Additional Sessions Judge-I, Jamtara in connection with Jamtara Cyber Crime P.S. Case No.06 of 2024, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
