The petitioner is apprehending his arrest in connection with Jamtara Cyber Crime P.S. Case No.51 of 2023 registered under Sections 414, 419, 420, 467, 468, 471 & 120(B) of the Indian Penal Code and Section 66(B)(C)(D) of the Information Technology Act, 2000.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. The petitioner has been implicated in the present case on the basis of alleged confessional statement of co-accused, namely, Dhaneshwar Mandal who was apprehended by the police at the spot. Similarly situated co-accused, namely, Birendra Mandal, whose name also surfaced in this case on the basis of the alleged confessional statement made by co-accused Dhaneshwar Mandal, has already been granted anticipatory bail by a Bench of this Court vide order dated 19^th February, 2024 passed in A.B.A. No.9785 of 2023. Though, one more criminal case i.e. Cyber Case No.73 of 2019 was lodged against the petitioner, however, he has already been acquitted in the said case vide

judgment dated 31^st August, 2020 passed by Additional Sessions Judge-I, Jamtara. Moreover, co-accused, namely, Birendra Mandal, who has already been granted anticipatory bail, has three criminal cases pending against him. The petitioner also undertakes to co-operate in the ongoing investigation. Hence, he may be given the privilege of anticipatory bail.

Learned A.P.P. opposes the petitioner’s prayer for grant of anticipatory bail.

Having heard learned counsel for the parties and considering that similarly situated co-accused, namely, Birendra Mandal has already been granted anticipatory bail in connection with the present case by a Bench of this Court, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Jamtara in connection with Jamtara Cyber Crime P.S. Case No.51 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
