06/22.08.2024 The petitioner apprehending his arrest in connection with the case registered under Sections 414/419/420/467/468/471/120(B) IPC and Sections 66(B), 66(C) & 66(D) of Information Technology Act has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence as alleged in the F.I.R. The petitioner has been implicated in this case on the alleged confessional statement of the apprehended co-accused Manik Kumar Mandal. Except the said confessional statement, there is no cogent material to connect the petitioner with the alleged offence. He has no criminal antecedent as has been stated in paragraph 7 of the present anticipatory bail application. Hence, he may be given the privilege of anticipatory bail.

Learned Spl. P.P while referring to the case diary, submits that two mobile phones and two pass books of the petitioners were found from the place of occurrence. On verification, it came to the light that that the said mobile phones were having different wallets created by the petitioner.

Having heard learned counsel for the parties and considering that except

the fact that the petitioner had created few wallets in his mobile phones, no other material has been placed before this Court in support of the fact that he was involved in commission of cyber crime as well as keeping in view that he has no criminal antecedent, I am inclined to enlarge him on anticipatory bail.

Accordingly, the above named petitioner is directed to surrender before the concerned Court below within a period of three weeks. If he surrenders before the Court below within the aforesaid period, he shall be released on bail on furnishing bail-bond of Rs.20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Jamtara in connection with Jamtara Cyber Crime P.S. Case No. 06/2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
