Heard the learned counsels for the parties.

The petitioner is an accused in connection with Haidarnagar P.S. Case No. 119 of 2021 corresponding to G.R. No. 237 of 2022 in S.T. Case No. 458 of 2022 registered under sections 387, 307, 120B of the Indian Penal Code and under section 27 of the Arms Act pending in the court of learned Additional Sessions Judge-II, Palamau at Daltonganj.

The learned counsel for the petitioner has submitted that allegations against the petitioner has been made when he was already in custody in Palur Jail in connection with Khelari P.S. Case No. 28 of 2020. It is further submitted that those who have disclosed the name of petitioner has having committed the offence or having been instructed by the petitioner to commit offence, have been granted bail, Abhishek Pandey @ Pandit has been granted bail in BA No. 2804 of 2022 vide order dated 13.04.2022, Dharmendra Choudhary has been granted bail in BA No. 3167 of 2022 vide order dated 06.05.2022 and Amit Choudhary @ Guddu has been granted bail in BA No. 6914 of 2022 vide order dated 06.07.2022. It is further submitted that unnecessarily the cases have been filed against the petitioner and it is also submitted that another case i.e. S.T. Case No. 42 of 2016 the petitioner has been acquitted by the learned Additional Sessions Judge II, Ramgarh vide judgment dated 11.05.2022. In S.T. No. 76A of 2017 the petitioner has been acquitted by the learned Additional Sessions Judge-IV, Ramgarh vide judgment dated 28.07.2021. It is further submitted that the petitioner has been allowed the privilege of bail in relation to Piparwar P.S. Case No. 04 of 2020, Piparwar P.S. Case No. 44 of 2022, Tandwa P.S. Case No. 132 of 2021 and in Tandwa P.S. Case No. 102 of 2021. Counsel has submitted that in the aforesaid circumstances, petitioner may be allowed the privilege of bail in this case.

Learned counsel for the State, on the other hand, has opposed the bail petition and submitted that the petitioner has as many as 123 criminal antecedent against him, moreover, the co-accused who have been granted bail had disclosed that they were acting on the instruction of this petitioner to commit crime, therefore, the petitioner may not be allowed bail.

Having heard both counsels, gone through the records of the case and in the facts and circumstances of the case, I am inclined to release the petitioner, named above, on bail, on furnishing bail bond of Rs. 25,000/(rupees twenty five thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Palamau at Daltonganj in connection with Haidarnagar P.S. Case No. 119 of 2021 corresponding to G.R. No. 237 of 2022 in S.T. Case No. 458 of 2022.
