Heard learned counsel for the parties.

Apprehending his arrest in connection with Raidih P.S. Case No. 42 of 2023 instituted under Section 414/34 of the Indian Penal Code, Section 11(1)(iv) of Cruelty to Animal Act, 1960 and Section 12(1)/13 (1) of Jharkhand Bovine Animal Prohibition and Slaughter Act, 2005, the petitioner has moved this Court for grant of privilege of anticipatory bail.

As per F.I.R., the allegation is that petitioner along with coaccused persons was allegedly involved in the transportation of bovine animals in a cruel manner with the intent to slaughter them. After interception of a truck loaded with bovine animals, one of which was found dead, one of the accused persons was apprehended while attempted to flee.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence at all rather he has been falsely implicated in this case. It is further submitted that petitioner name has been surfaced on the basis of confessional statement of co-accused. Petitioner has no criminal antecedent and undertakes to co-operate with the investigation of the case and also abide by all terms and conditions imposed by this Court in the matter of granting anticipatory bail. It is lastly submitted that other co-accused persons with similar allegation have been granted anticipatory bail by Coordinate Bench of this Court vide order dated 03.04.2024 passed in A.B.A. No.1140 of 2024 and vide order dated 25.04.2024 passed in

A.B.A. No.1725 of 2024. The case of petitioner stands on better footing. Hence, the petitioner may be extended the privilege of anticipatory bail. 5. Learned Addl.P.P appearing for the State has opposed the prayer for anticipatory bail of the petitioner but so far the matter of party is concerned, he has submitted that petitioner is on similar footing with the other co-accused persons who have granted anticipatory bail.

Considering the facts and circumstances of this case, the nature of allegation against petitioner coupled with materials available on record, I am inclined to extend privilege of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court within four weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, Gumla in connection with Raidih P.S. Case No. 42 of 2023 with the condition that he will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the pendency of the case and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
