Petitioner is apprehending his arrest in connection with Bariatu P.S.Case No. 373 of 2021 for the offences registered under Sections 406/420/120B/467/468/471 of the IPC, pending in the court of learned JMFC, Ranchi.

Submission has been made by the learned counsel for the petitioner that on the same day of occurrence another case being Bariatu P.S. Case No. 254 of 2020 under Section 143/147/149/448/341/342/506/504 of the IPC has been lodged by the informant of the present case, in which the name of petitioner is not there and one of the co-accused Naina Oraon who is accused in the said FIR and is also accused in the present FIR. He further pointed out that there is no specific allegation against this petitioner regarding forgery or doing any misdeed.

He further pointed out that co-accused Nayana Oraon @ Naina Oraon has already been admitted to anticipatory bail by co-ordinate bench of this Court in ABA No. 10439 of 2023. Upon the aforesaid premise, the prayer for anticipatory bail has been made.

Learned APP appearing for the State has opposed the prayer for anticipatory bail but conceded to the fact that similarly situated other coaccused namely Nayana Oraon @ Naina Oraon has already been admitted to anticipatory bail.

Heard the parties and perused the record.

Considering the nature of offence and allegation against the petitioner and also the fact that one of the co-accused namely Nayana Oraon @ Naina Oraon has already been admitted to anticipatory bail, this Court finds no reason to take distinct view in the case of the petitioner, as such this Court finds it fit case to grant anticipatory bail to the petitioner.

Accordingly, petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of a copy of this order and the learned court below on his surrender, shall release him on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned JMFC, Ranchi, in connection with Bariatu P.S.Case No. 373 of 2021, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
