Petitioner has been made accused in connection with Govindpur P.S. Case No. 51 of 2023, for the offences registered under section 395 of the I.P.C. and added Section 397 of the I.P.C. and Section 27 of the Arms Act, pending in the court of Sri Rajiv Tripathi, learned Judicial Magistrate, 1^st Class, Dhanbad.

On 09.02.2023 at about 2:55 A.M., the informant was sleeping in his truck which was parked outside a hotel in Govindpur. He had gone to meet call of nature and saw some people removing diesel from the parked vehicles, when the informant protested, one of the accused person fired at him causing injury, thereafter, the dacoits fled away.

It was submitted that petitioner is neither named in the F.I.R. nor he was put on T.I. Parade. It was further submitted that nothing incriminating has been recovered from the possession of the petitioner.

Mr. Sanat Kumar Jha, learned A.P.P. has opposed the prayer for bail.

From the perusal of the impugned order, it appears that name of the petitioner had transpired in confessional statement of co-accused, Rakesh Kumar Vishwakarma. He has also confessed his guilt.

Considering the fact that apart from confession, there is no other material against the petitioner on the record, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Rajiv Tripathi, learned Judicial Magistrate, 1^st Class, Dhanbad or his successor in connection with Govindpur P.S. Case No. 51 of 2023.
