04/22.04.2024 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Gandey P.S. Case No.30/2023, registered for the alleged offence under Sections 379/411/413/414 of the Indian Penal Code, pending in the Court of the learned C.J.M., Giridih.

Learned counsel for the petitioner submits that the motorcycle of the informant was recovered from the possession of one Mazid Ansari and the apprehended co-accused has taken name of this petitioner. He submits that the petitioner has got no criminal antecedent, which has been disclosed in paragraph 14.

Learned counsel for the State opposed the prayer on the ground that the name of the petitioner has come on the confessional statement of the apprehended co-accused.

Considering that the motorcycle was not recovered from the possession of this petitioner and the name of the petitioner has come on the confessional statement of the apprehended co-accused and he has got no criminal antecedent and in the attending facts and circumstances of the

case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Giridih in connection with Gandey P.S. Case No. 30/2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
